(3) Bad-faith Trademarks
RCEP and ETA require that a bad-faith trademark ap-
plication shall be declined, or a bad-faith trademark
registration shall be cancelled, which is not provided
in CPTPP.

names that was not provided in TRIPs, and grant rem-

(4) Term of Trademark Protection
TRIPs, Article 18 states that initial registration, and
each renewal of registration, of a trademark shall be
for a term of no less than 7 years. However, CPTPP,
Article 18.26 Term of Protection for Trademarks
provides that initial registration and each renewal of
registration of a trademark is extended to 10 years.
Although no specific term is provided in RCEP, the
term of trademark protection shall no less than 7 years
pursuant to RCEP.
3. Patents
(1) Rights Conferred
RCEP lists the exclusive rights that shall be conferred
on the patent right holders by the Parties19, while no
relevant clause is provided in CPTPP.
