Comparison of Purposes of the Intellectual Property
Sections in the CPTPP, RCEP, CAI and ETA

RCEP specifies that the IP section aims at promoting
intraregional trade liberalization, and IP serves free
trade. Its main purpose is to reduce distortion and im-
pediments to trade and investment, by promoting eco-
nomic integration and cooperation through the effec-
tive and adequate creation, utilization, protection, and
enforcement of intellectual property rights, while con-
sidering the Parties?? different levels of economic devel-
opment and capacity, as well as differences in national
legal systems, and seeking a balance between the rights
of IP rights holders and the legitimate rights and inter-
ests of IP users.7
In terms of this purpose, RCEP requires each Party to
grant the other Parties national treatment in intellectual æ¡??ä¸???¨ç??¥è?产æ?æ²»ç?ï¼???¥ç?çº??ä¸??ä¸?
property protection.8 In addition to requiring partici-
pation in the Agreement on Trade-Related Aspects of In-
tellectual Property Rights ((hereinafter, ??RIPs??) of the
World Trade Organization, RCEP requires the Parties
join global intellectual property governance within the
framework of the World Intellectual Property Organi-
zation (hereinafter, ??IPO????), namely they shall ratify
or accede to the multilateral agreements under WIPO
to which it is not yet a party.9
On the contrary, ETA intends that both parties shall
ensure fair, adequate and effective intellectual property
protection and enforcement, and provide fair and equi-
table market entry. Therefore, the ETA requires China
to make specific commitments in response to the specif-
ic intellectual property issues of concern to the United
States. The ETA is bilateral and targeted, rather than a
universal system within the framework of WIPO as it
is in RCEP.
