means that facilities located outside of
designated industrial parks (“scattered”),
those without proper permitting
documents (“messy”) and those with a
poor environmental record or without

can expect increased scrutiny and
potential closure/relocation.

How Can Facilities
Protect Themselves?

ERM recommends that industrial
facilities operating in Southern
China take the following steps to
minimize the risk of shut down,
fines and/or relocation:

a. Establish an effective Compliance
Assurance Program for your own
facilities as well as those of your supply
chain (suppliers);

b. Undertake soil investigations and
proactively (discreetly) address soil
pollution issues for companies that are
occupying contaminated sites;

c. Monitor and check local
government websites for new
requirements for companies that are
currently on “supervision lists”;

d. Assess the supply chain risk,
beginning with critical suppliers; and

e. Select site for new facilities wisely, well
informed of future land-use, industrial
zoning and regulatory changes.■
